On Wednesday, June 20 the Water Policy Interim Committee, established by the Montana Legislature, will hold a meeting in Kalispell to receive public input on proposed legislation dealing with the problem of exempt wells in Montana.
A water well drawing less than 35 gallons per minute and producing less than 10 acre-feet of water per year is considered exempt from the well permitting process in Montana. There are currently more than 100,000 exempt wells in the state that are not subject to any monitoring or mitigation requirements. Nearly 6,000 exempt wells were drilled in Flathead County between 1991 and 2011.
Exempt wells can withdraw thousands of acre feet of water from an aquifer and can seriously reduce flows in nearby streams, especially during the critical low-water period in late summer and fall. Several areas of the state are seeing their streams warming or even drying up in closed groundwater basins due to overuse from un-monitored and non-permitted groundwater withdrawals. Grouping too many homes served by exempt wells and septic systems in a small area, particularly in a closed groundwater basin, can have catastrophic affects on nearby streams.
